All membership, training, service contracts and other additional services of Holmes Place are concluded exclusively on the basis of these general terms and conditions.
Persons under 16 years of age are not accepted as members. Contracts for the membership of minors are only concluded by Holmes Place with their legal representatives. The club membership cannot generally be transferred, with the exception of corporate memberships subject to the following provisions. Assignment of rights or any other disposition over the member's contractual rights is excluded. The club member may not lend the membership card or allow third parties to use it.
a) Members with a regular membership may use the club without restriction during opening hours. Memberships apply exclusively to the club specified in the contract, unless the contract expressly states that the member is permitted to use other clubs. Restrictions may apply to other membership types confirmed by the member at sign-up. For discounted memberships, the member must prove their eligible status by appropriate documents before signing. The member must immediately inform Holmes Place of any end to their eligible status. A damage caused by a late notification attributable to the member must be compensated by the member. If the conditions for a discounted membership no longer apply, the membership may continue under the terms of a regular membership.
b) In addition to club memberships, Holmes Place offers further add-ons for which a separate agreement can be concluded.
c) Rest periods: Members may apply for monthly rest periods. A prerequisite is a balanced contribution account. Holmes Place decides on granting them. Valid reasons are physical limitations that temporarily prevent use of the offering, or work-related absence. Applications must be supported by a medical certificate or employer's confirmation. In any case, the current term of the service agreement is extended by the duration of the rest period. Fees already paid are automatically offset against fees due after the rest period.
d) In the event of payment arrears of more than 3 months under a contract of up to 6 months, the entire remaining amount until the next possible cancellation date becomes immediately due. For arrears exceeding three months, the agreed payment method is switched to semi-annual and all amounts for the next 6 months from the arrears date (or until the end of the contract term) become immediately due. Holmes Place may engage a debt collection agency and attorney at the member's expense.
e) Holmes Place carries out a credit check with SCHUFA as a pre-contractual measure to protect against payment defaults. The contract is subject to the condition precedent (§ 158 I BGB) of a positive SCHUFA credit rating. See section 14 (Data Protection) for further details. In the event of a negative credit check, Holmes Place may offer a contract requiring the member to pay the monthly amount in advance.
a) Member fees cover the standard services of a fitness contract — in particular use of equipment, standard group classes, and wet areas — regardless of actual use. Not included are additional services offered by the club (e.g. catering, drinks, diagnostics, lockers, spa, parking, towels, personal training, specially designated class and training formats, and other services). A separate contract for additional services does not become part of the main contract.
b) The initial payment stated in the membership contract is due upon signing. Member fees are payable monthly, bi-weekly, or weekly in advance and are collected exclusively by SEPA direct debit from a current account. Holmes Place is entitled to delegate or transfer payment processing to a third party. The member must maintain the direct debit authorisation and ensure sufficient funds. The member must reimburse Holmes Place for any damage caused by a returned direct debit attributable to the member, including bank charges and additional administrative costs.
c) The amounts stated in the membership contract include the applicable VAT. Changes to the statutory VAT rate are passed through accordingly.
d) If the member falls into arrears on a member fee, Holmes Place is entitled to block the membership card and deny access to the club until arrears are cleared.
e) If the member loses or damages the membership card, towel card, or other items provided by Holmes Place (which do not pass into the member's ownership), replacement is chargeable. Holmes Place will inform the member transparently of the applicable costs.
f) Membership cards are personal and may not be transferred or exchanged with other persons. Violation entitles Holmes Place to terminate the membership.
A contract for the additional service "Personal Training" is concluded between the customer and Holmes Place. The respective Holmes Place club commissions (freelance) trainers to deliver the service. This service is club-specific and not transferable to other clubs.
a) Personal Training products are available as a pack and as a subscription. For a pack, a standard validity period in weeks equal to twice the number of training sessions applies (e.g. a 4-session pack = 8 weeks). Pack hours expire if not used within that period. Example: a 4-session pack is valid for 8 weeks from the date of purchase; unused hours expire after 8 weeks.
b) The subscription has a minimum term of 4, 6, or 12 months depending on the member's choice. Ordinary cancellation is not possible during the minimum term. After the minimum term, the subscription automatically continues indefinitely and can be cancelled at any time with one month's notice to the end of a calendar month. Unless otherwise stated in the supplementary contract, the default minimum term for VIP subscriptions is 4 months.
c) The availability of specific trainers cannot always be guaranteed. Trainer selection is made by appointment with the Personal Training Manager.
d) The member must cancel a Personal Training appointment at least 24 hours in advance. If cancelled later, the session is deemed used, unless a replacement session can be provided.
e) Holiday periods (= absence of up to 4 weeks) must be coordinated with Holmes Place and the trainer. Sessions not attended due to holidays or other reasons must be made up within the validity or contract period, ideally beforehand, but at the latest immediately after the holiday or in the following month.
f) Special case "holiday period": Another reason does not apply if the customer is permanently unable to attend training sessions due to illness or similar circumstances beyond their control. The customer must provide appropriate proof. In this case, the service may be obtained at a later date without additional charge, or transferred to another person.
g) Holmes Place permits a contract rest period ("Freeze") at its own discretion and as a goodwill gesture. The contract term is extended by each month the contract is on hold. Freeze entitlements for subscriptions are:
This pause must be requested one month before the selected calendar month.
h) Members using a subscription must use their Personal Training hours within the respective calendar month or in the following month. After the end of the second month, the entitlement to Personal Training hours from the previous month expires (e.g. VIP4 hours from October expire at the end of November). Pack hours expire if not used within double the pack's weeks. The provisions under f) do not apply if the inability to attend is not attributable to the member due to sports incapacity resulting from illness or other demonstrable reasons, evidenced by a medical certificate or otherwise.
i) Due Personal Training hours that the member cannot attend themselves may be transferred to friends and family.
j) For clarification: only the VIP Starter model with 4 months is offered as the "Express" option.
k) Cancellations and Freezes must be submitted via the homepage.
Holmes Place is entitled to increase or reduce member fees and other services to reflect changes in the overall costs associated with our service. The member is entitled to claim an adjustment of the member fee.
Examples of cost elements influencing the price of our subscription offerings:
All price changes take effect no earlier than 30 days after announcement. You may terminate your membership at any time during the applicable notice period to avoid future charges.
a) Advance booking via Holmes Place's booking platform Eversports is required to attend classes, as capacity is limited. Bookings can be made via https://www.eversports.de or the Eversports smartphone app. A one-time registration with Eversports is required. Members already registered may log in and book directly.
b) Members book activities via the Eversports timetable. The required product "Member Class Visit (Club)" is displayed automatically at zero cost and covers all included classes. After booking, a confirmation email is sent. Bookings are visible under My Bookings > Upcoming Bookings. Waitlist registration is possible for fully booked classes; a push notification is sent if a spot becomes available (if enabled).
c) A "No-Show" occurs when a member makes a class booking, culpably fails to cancel at least 12 hours before the start, and culpably does not attend despite the uncancelled booking. Classes cancelled or moved by Holmes Place do not count as No-Shows.
d) A temporary booking ban is only imposed when three culpable No-Shows have been provisionally recorded within a calendar quarter. No-Shows from previous quarters are disregarded.
e) After each provisional No-Show, the member is notified and given the opportunity to prove lack of fault by submitting explanations and supporting documents (e.g. medical certificate, official notice, accident confirmation). Holmes Place reviews the information promptly and removes the provisional No-Show if no fault is found.
f) Not culpable includes in particular:
g) Once 3 culpable No-Shows in a calendar quarter are reached, the member receives a final notice requesting justification or additional evidence. No booking ban takes effect before this deadline expires.
h) If no justification is provided or it is unfounded, Holmes Place may impose a temporary class-booking ban of up to 7 calendar days. Existing bookings remain unless the member requests cancellation. Club access, other services, and the contract term are unaffected by the ban. The ban does not extend automatically.
i) All No-Show counts are reset to zero at the end of each calendar quarter; counting begins anew in the new quarter.
j) Holmes Place considers the particulars of each individual case and the member's interests and decides proportionately and transparently. Members are encouraged to keep their contact and notification details up to date and to manage bookings carefully.
k) This policy ensures that class places are reliably used and that all members have a fair chance to participate. Unused bookings leave capacity unfilled that could otherwise have been allocated to another member.
a) Holmes Place may terminate the contract with one month's ordinary notice at the end of the respective contract term.
b) Statutory provisions apply to extraordinary termination without notice. A material reason for extraordinary termination exists in particular if:
c) If the member is responsible for the extraordinary termination, Holmes Place is entitled to claim damages for non-performance of the contract. The member may then be excluded from memberships at all Holmes Place Health Clubs.

The member undertakes to follow justified instructions from staff required for safety or the smooth running of club operations, to observe hygiene requirements, and to comply with the club rules and house rules posted in the club. Serious and/or repeated violations entitle Holmes Place to issue a ban and to give extraordinary notice of termination without notice. Holmes Place reserves the right to amend the club rules or house rules to the extent reasonable and legally permissible.
Holmes Place continuously informs about opening hours and service offerings, in particular on www.holmesplace.de. Opening hours may be extended or reduced as necessary and reasonable, e.g. on public holidays, for inspections, or renovation and cleaning work. Holmes Place will announce changes to opening hours or closures of rooms with appropriate notice.
Holmes Place is entitled to modify individual service offerings provided that the modification is reasonable for the member, taking into account Holmes Place's interests, and that the main contractual services remain substantially unchanged.
a) Members are personally responsible for their state of health and individual physical capacity when using Holmes Place's offerings.
b) Holmes Place is fully liable for intentional or negligent injury to life, body, or health. For other damages, Holmes Place is only liable in cases of gross negligence or intent, and in cases of negligent breach of essential contractual obligations by its legal representatives or agents. Essential contractual obligations are those whose fulfilment characterises the contract and on which the customer may rely.
c) Lockers are provided by Holmes Place without supervision. Members are responsible for adequately securing lockers they use or rent. Holmes Place is not liable for items stolen from lockers, unless Holmes Place or its representatives acted intentionally or with gross negligence. Valuables should not be stored in lockers.
Holmes Place employees, with the exception of the Club Manager, are not authorised to make agreements that deviate from the contract form or these general terms and conditions. The provisions contained in the contract form and these general terms and conditions represent the entire agreement reached between Holmes Place and the member. No verbal side agreements exist.
We process your data exclusively for the purpose of establishing, performing, and processing your membership, on the basis of statutory provisions, in the context of our legitimate interests, and where applicable on the basis of your consent. You will receive offers from us for similar goods or services at your stated email address, mobile number, by push notification, or by post. You may object to this processing at any time by email to dataprotection_DE@holmesplace.de, via www.holmesplace.de, or by post to Holmes Place, Charlottenstr. 65, 10117 Berlin. Holmes Place transmits personal data collected in the context of this contractual relationship — including data on application, performance, and termination of the business relationship, and data on non-contractual or fraudulent conduct — to SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden. For contracts not concluded on the premises (within the meaning of § 312c I BGB), the member has the right to withdraw from this contract within fourteen days without giving reasons.

In the event of an effective withdrawal, the services received by both parties must be returned and any benefits derived (e.g. advantages from use) must be surrendered. If the member cannot return the received service in full, in part, or in a deteriorated condition, the member must pay compensation for the value.
If the member used services before the withdrawal period expired, a proportional fee will be charged based on the value of services rendered up to the time of withdrawal. Any payment already made will be refunded after deduction of the value of services used.
